GENERAL CONDITIONS OF SALE
GENERAL PROVISIONS
These conditions are valid exclusively between the company BIJONDO S.r.l., with registered office in Via Giuseppe Libertini, 55 - 73100 Lecce (LE), REA LE-335169, P.IVA 05007610750, hereinafter referred to as ''BIJONDO'' and any person who makes online purchases on the website www.bijondo.com hereinafter referred to as ''CUSTOMER''. These conditions may be subject to change and the date of publication of the same on the site is equivalent to the date of entry into force.
These conditions govern purchases made on the website www.bijondo.com, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree no. 206/2005, as amended by Legislative Decree no. 21/2014 and Legislative Decree no. 70/2003 on electronic commerce.
1 ARTICLE 1 - SUBJECT OF THE CONTRACT
With these general conditions of sale, BIJONDO sells and the CLIENT buys at a distance the movable goods indicated and offered for sale on the website www.bijondo.com. The contract is concluded exclusively through the Internet, through the access of the CLIENT to the address www.bijondo.com and the realization of a purchase order according to the procedure provided by the website itself.
The CUSTOMER undertakes to read, before confirming his order, these general conditions of sale, in particular the pre-contractual information provided by BIJONDO and to accept them by placing a flag in the box indicated.
In the order confirmation e-mail, the CUSTOMER will also receive the link to download and store a copy of these general conditions of sale, as provided by art. 51 paragraph 1 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014.

ARTICLE 2 - PRECONTRACTUAL INFORMATION FOR THE CONSUMER - ART. 49 OF LEGISLATIVE DECREE 206/2005
The CUSTOMER, prior to the conclusion of the purchase contract, takes note of the characteristics of the goods that are illustrated in the individual product data sheets at the time of the CUSTOMER's choice.
Before the validation of the order with "payment obligation", the CUSTOMER is informed about:
- total price of the goods including taxes, with details of shipping costs and any other costs;
- method of payment;
- the deadline by which BIJONDO undertakes to deliver the goods;
- conditions, terms and procedures for exercising the right of withdrawal (art. 6 of these conditions) as well as the standard withdrawal form in Annex I, part B of Legislative Decree 21/2014;
- information that the CUSTOMER will have to bear the cost of returning the goods in case of withdrawal;
- existence of the legal guarantee of conformity for the goods purchased; - conditions of after-sales service and commercial guarantees provided by BIJONDO.
The CUSTOMER may at any time and in any case before the conclusion of the contract, take knowledge of the information relating to BIJONDO, geographical address, telephone number, e-mail address, information that is reported, even below:

ARTICLE 3 - CONCLUSION AND EFFECTIVENESS OF THE CONTRACT
The contract of sale is considered concluded with the sending by BIJONDO to the CUSTOMER of an e-mail confirming the order. The e-mail contains the CUSTOMER's details and the order number, the price of the goods purchased, the shipping costs and the delivery address to which the goods will be sent.
The CUSTOMER undertakes to verify the correctness of the personal data contained in the above mentioned e-mail and to promptly communicate to BIJONDO any corrections/modifications to be made.
BIJONDO undertakes to describe and present the items sold on the site in the best possible way. Nevertheless, some errors, inaccuracies or small differences between the product depicted on the site and the real product may occur. Furthermore, the photographs of the products presented on www.bijondo.com do not constitute a contractual element, as they are to be considered only representative.
BIJONDO undertakes to deliver the goods within 30 days after BIJONDO sends the order confirmation e-mail to the CUSTOMER.

ARTICLE 4 - AVAILABILITY OF PRODUCTS
The availability of products refers to the actual availability at the time the CUSTOMER places the order. Such availability must in any case be considered purely indicative since:
- the products could be sold to other CUSTOMERS before the order confirmation, due to the simultaneous presence on the site of several users,
- a computer anomaly may occur that makes a product available for purchase that is not actually available for purchase.
Even after sending the order confirmation e-mail sent by BIJONDO, there could be cases of partial or total unavailability of the goods. In this case, the order will be automatically corrected with the elimination of the product or products not available and the CUSTOMER will be immediately informed by e-mail; with this e-mail the customer will also be informed of the methods and timing of reimbursement of any sums paid.

ARTICLE 5 - PAYMENT METHODS
Any payment by the CUSTOMER can be made by various payment methods.
The actual charge will be made when BIJONDO sends the order confirmation e-mail.

ARTICLE 6 - PRICES
All sales prices of the products indicated on the website www.bijondo.com are expressed in Euro and include the Italian VAT.
Shipping costs are not included in the purchase price, but are indicated and calculated at the time of conclusion of the purchase process before payment is made.
The CUSTOMER accepts BIJONDO's right to change its prices at any time, however, the goods will be invoiced on the basis of the prices indicated on the site at the time the order is created and indicated in the confirmation email sent by BIJONDO to the CUSTOMER.
In the event of a computer, manual, technical, or any other error that may result in a substantial change, not foreseen by BIJONDO, in the price of sale to the public, which makes it exorbitant or clearly derisory, the purchase order will be considered invalid and cancelled and the amount paid by the CUSTOMER will be refunded within 14 days from the day of cancellation.

ARTICLE 7 - RIGHT OF WITHDRAWAL
In accordance with the legal provisions in force, the CUSTOMER has the right to withdraw from the purchase without penalty and without specifying the reason, within 14 days from the date of receipt of the products.
The CUSTOMER who intends to exercise the right of withdrawal must communicate this to BIJONDO by means of an explicit declaration, which may be sent by registered letter with return receipt.
The CUSTOMER may also exercise the right of withdrawal by sending any explicit declaration containing the decision to withdraw from the contract or alternatively send the standard withdrawal form, as per Annex I, part B, Legislative Decree 21/2014 (not mandatory) whose text is given below:

In case of exercise of the right of withdrawal, the CUSTOMER is required to return the goods within 14 days from the day on which he/she has communicated to BIJONDO his/her intention to withdraw from the contract pursuant to art. 57 of Legislative Decree 206/2005.
The goods must be returned to BIJONDO S.r.l., at its headquarters in Via Giuseppe Libertini, 55 - 73100 - Lecce(LE).
The goods must be returned intact, in the original packaging, complete in all its parts and complete with the attached fiscal documentation. Without prejudice to the right to verify compliance with the above, BIJONDO will refund the amount of the products subject to withdrawal within a maximum period of 14 days.
With regard to the return of the product subject to withdrawal, all shipping costs will be charged to you (art. 56 co. 2 dlgs 206/2005).
The customer is also entitled to return the product purchased online at all BIJONDO Italia sales points. In this case, it is not necessary to create the online return file and all costs related to the return will be charged to the customer (eg: gasoline, disassembly of the product, etc.).
As provided by art. 56 paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, BIJONDO may suspend the refund until the receipt of the goods or until the CUSTOMER demonstrates that the goods have been returned to BIJONDO.
BIJONDO will make the refund using the same means of payment chosen by the CUSTOMER during the purchase.
*It is understood that in case of defect of the product the shipping costs will in any case covered by BIJONDO.

ARTICLE 10 - DELIVERY METHODS
The products will be delivered by express courier to the address indicated by the CUSTOMER at the time of order no later than 30 days from the date of receipt by the CUSTOMER of the order confirmation email sent by BIJONDO.
For each order placed on the website www.bijondo.com, BIJONDO will issue an invoice for the goods shipped. The invoice is available and printable, after the processing of the order, in the "My orders" section of the space "My BIJONDO account" of the CUSTOMER. The invoice will contain the information provided by the CUSTOMER during the purchase process. After the invoice has been issued, it will not be possible to make any changes to the data indicated in the invoice.

ARTICLE 11 - LIABILITY
BIJONDO does not assume any responsibility for inefficiencies attributable to force majeure or fortuitous circumstances, even if dependent on malfunctions and inefficiencies of the internet network, in the event that it is unable to execute the order within the time provided for in the contract.

ARTICLE 12 - ACCESS TO THE SITE
The CUSTOMER has the right to access the site for consultation and making purchases. No other use, in particular commercial use, of the site or its content is allowed. The integrity of the elements of this site, whether sound or visual, and the technology used remain the property of BIJONDO and are protected by intellectual property law.

ARTICLE 13 - COOKIES
The website www.bijondo.com uses ''cookies''. Cookies are electronic files that record information related to the CUSTOMER's navigation in the site (pages consulted, date and time of consultation, etc...) and that allow BIJONDO to offer a personalized service to its customers.
BIJONDO informs the Customer of the possibility to deactivate the creation of such files.

ARTICLE 14 - INTEGRALITY
These General Terms and Conditions of Sale are made up of all the clauses that make them up. If one or more provisions of these General Terms and Conditions of Sale are considered invalid or declared invalid by law, regulation or following a decision by a court having jurisdiction, the other provisions shall continue to have full force and effect.

ARTICLE 15 - APPLICABLE LAW AND COMPETENT FORUM
These General Conditions of Sale are subject to Italian law.
Any dispute that cannot be amicably settled shall be submitted to the exclusive jurisdiction of the Court of the place of residence or domicile of the CLIENT, if located in the Italian territory.
In any case, it is possible to optionally resort to the mediation procedures provided for by Legislative Decree 28/2010, for the resolution of any disputes arising in the interpretation and execution of these conditions of sale by accessing the following website: https://webgate.ec.europa.eu/odr.
